Terms and Conditions

To provide dental outpatient and dental services to patients of the Alföldi DENTAL SYSTEM Limited Liability Company

These General Terms and Conditions (GTC) govern the terms of the agreement between the Parties for the provision and use of health services, namely between Alföldi Dental System Kft., as the health service provider (hereinafter referred to as the ‘Service Provider’), and the Patient receiving the service.
Unless the Service Provider and the Patient agree otherwise in writing, these General Terms and Conditions shall prevail. By signing the Contract, the Patient acknowledges that they have read and understood the GTC and accepts to be bound by it.
The patient acknowledges that the health insurance benefit does not cover the fees of the health services used in the Alföldi Dental System dental office.

Health Service

Alföldi Dental System Kft. (H-1116 Budapest, Szent Gellért tér 3. I. em. 2.; Company Registration Number: 01-09-566323, VAT number: 12226050-1-43) represented by Dr Antal Alföldi, managing director.
The Service Provider has the necessary professional, material and personal conditions for the provision of services, appropriate official permits, as well as a medical liability insurance contract related to the performance of its activities.

By using the Service, a cooperation obligation is created between the Parties. In addition to their personal data, the patient’s obligation to inform extends to the description of the circumstances, history and facts related to their health condition, which are necessary for the establishment of the appropriate diagnosis, the preparation of the adequate treatment plan and the performance of successful interventions. Priority is given to information on previous known diseases, treatments, drug therapies, drug sensitivity, and health risk factors. In addition, information on everything related to their own illness that may endanger their own life or the life or physical integrity of others, in particular infectious diseases and diseases that preclude them from undergoing an intervention.

The Patient is solely responsible for the accuracy and authenticity of the information provided by them regarding their personal data, health status, diseases or previous treatments, for which the Service Provider is not responsible. In the event of a deficiency or delay in the data provided by the Patient, the Service Provider is entitled to modify the treatment plan as well as the related Quotation.

The Patient is obliged to notify the Service Provider immediately in case of any change in the previously provided information. The Patient acknowledges that the Service Provider shall not be liable for any damages arising from the failure to notify. In the event of a breach of the above obligations, the Patient shall be obliged to pay the resulting damage of the Service Provider as well as the incurred, justified and confirmed costs. In the event of a breach of contract arising from the above, the Service Provider is entitled to terminate the contract with immediate effect (without compensation).
During the entire care of the Patient, the Service Provider provides the treatments and the necessary dental technology work by using qualified dental specialists, assistant specialists and subcontractors in accordance with high-level professional protocols.

An advance appointment is required for dental care. The patient is obliged to arrive at the pre-arranged time on time (10 minutes before the start of the treatment). If the Patient wishes to cancel the pre-arranged appointment, they may do so no later than 24 hours before the agreed time. In the absence of timely cancellation, the Service Provider is entitled to invoice the “availability fee” included in its Price List to the Patient.

The Service Provider endeavours to provide the care of its Patient at the time confirmed to them. Due to the nature of the care, the time of the appointment may change, so the Service Provider is not responsible for the provision at a previously booked, confirmed time. The Service Provider is entitled to change, cancel or reschedule the date of treatment at any time by notifying the patient. The patient cannot claim compensation for the above reasons.

The patient is obliged to appear in a sober state, as well as in a physical and psychological state suitable for health care and not to disturb the peace of those staying in the waiting room during the provision of the service. In the absence of these, the Service Provider is entitled to refuse to provide the service.
The patient is responsible for complying with the provisions received from the Service Provider and their doctor regarding their medical treatment. The Service Provider shall not be liable for any damages arising from the failure of compliance, and the Patient shall not be entitled to compensation for this reason.

Data Management

By signing the admission form, the Patient consents to the processing of their personal data and accepts the provisions of these General Terms and Conditions.
The Patient agrees that the Service Provider will treat and record the personal identification, health and other data provided by the Patient and recorded during the health service as a business secret in accordance with the applicable laws.

The Patient acknowledges and accepts that an image is taken during their treatment in the course of the Service for security reasons.

The Service Provider declares that it will keep confidential the data related to the patient’s person and health condition that it becomes aware of during the provision of the Service.
The Patient consents to the Service Provider recording their contact details in its own database, using these information to contact them about their treatments and the current information of the Service Provider.

Service Remuneration, Payment

The Service Provider undertakes to provide the Patient with full information about the content of the treatment deemed necessary and the fee of the Service before starting the treatment. The Service Provider shall, upon special request, provide a written Quotation based on the Price List in force at the time.. The written quotation is valid for 3 (i.e. three) calendar months, unless otherwise stated in the quotation.

The patient acknowledges and accepts that the fees included in the Quotation are envisaged fees, which may vary depending on other interventions arising during the treatment.

Care may be provided to the patient by the Service Provider upon payment of the applicable agency fee. The current Price List of Alföldi Dental System Kft. is available at www.alfoldident.hu or in printed form at the dental office. The Service Provider is entitled to change the prices of the treatments without prior notice.
The fees for dental services can be paid by the Patient in the following ways:

  • in cash,
  • with a debit card,
  • by bank transfer in the case of an individual agreement,
  • health fund card (contracted funds only).

Fees are scheduled to be paid in accordance with the agreement with the attending dentist.

Possibility of Withdrawal

During the treatments, the Patient may, at their own risk, request the interruption of the treatment (to be continued at a later date) or the discontinuation of the treatment at any time. In this case, the Patient is only obliged to pay a fee for the services that they have used until the notification of the termination or that have already been performed by and towards the Service Provider (e.g. dental technology work). The Service Provider shall not be liable for any health damage that may occur as a result of treatment discontinued at the request of the patient.
The Service Provider reserves the right to refuse to perform the Service if the Patient does not or only partially fulfills their payment and other contractual obligations. For the refusal of the service by the Service Provider, for the reasons indicated in this point, the Patient may not enforce a claim against the Service Provider, and the Service Provider expressly excludes its liability for damages.

Patient Law, Complaint Management

The patient is entitled to all patient rights and has the right to complain in writing to the Service Provider about the health service. The Service Provider has a 30-day deadline for investigating and responding to this in writing. The patient can use the help of a legal representative.

Warranty

Alföldi Dental System Kft. offers a warranty on all treatments it performs.

Any warranty claims will be handled only in the office of Alföldi Dental System Kft., after prior consultation.

  • implant (for falling out or loosening) – 5 (i.e. five) years of warranty (warranty does not cover the abutment, implant-supported prostheses – crowns/bridges – and travel/accommodation costs)
  • implant abutment – 2 (i.e. two) years
  • fixed prostheses – 1 (i.e. two) years
  • removable prostheses – 1 (i.e. one) year
  • porcelain layering – 1 (i.e. one) year
  • fillings, inlays – 1 (i.e. one) year

In the case of implants, the Service Provider’s warranty can only be provided if the Patient complies with the warranty conditions.

The Service Provider is exempted from its warranty obligations if any of the following conditions of the warranty are not met or there are grounds for exclusion:

  • compliance with the full oral hygiene regulations prescribed by the attending physician
  • attendace at the follow-up examinations recommended by the attending dentist every 6 months;
  • facilitating the interventions recommended by the attending dentist within 30 days;
  • the failure of the treatment is caused by other health factors independent of dental care;
  • the patient is addicted to alcohol or drugs, that can be associated with the failure of the treatment;
  • the patient seeks treatment on the tooth in question in another dental office;
  • any financial debts owed to the Service Provider.

Liability

According to the contract governing its activities, the Service Provider shall only be liable for damages caused by the Service Provider or its personnel intentionally or with gross negligence.

Scope of GTC

This GTC covers the dental services of the Alföldi Dental System dental office.
The Service Provider is entitled to amend the GTC without restriction of content and time, and without prior notice.

Miscellaneous Provisions

The service is only available to persons of legal age / over 18 years of age. Minors may use the service only with the written consent of their legal representative in accordance with Hungarian legal requirements.

The Patient acknowledges and agrees that the Service Provider may use subcontractors for the performance of the ordered services, medical care, other special interventions and medical treatments. The Service Provider shall be responsible for the activities performed by the subcontractors as if it had performed them itself.

Issues not regulated in the present GTC shall be governed by the provisions of the Hungarian legislation in force (Act V of 2013 on the Hungarian Civil Code). In the event of a dispute, the Hungarian Court shall have jurisdiction, proceeding in Hungarian.

Obligations of patients

  • must respect the rights of the healthcare provider, the employees of the healthcare provider and their fellow patients;
  • must not violate the statutory rights of healthcare workers;
  • is obliged to respect the operational rules and internal regulations of the Health Service Provider;
  • they are obliged to cooperate with the healthcare professionals involved in their care according to their best abilities and knowledge, to inform them about everything necessary for the diagnosis, the preparation of the adequate treatment plan and the performance of the interventions.
